EB-1A processing time in 2026
The short answer: USCIS adjudicates an EB-1A Form I-140 in 6 to 13 months on regular processing or 15 business days with premium processing. But the I-140 decision is only the first half of getting your green card. Total time from filing to physical green card is typically 12 to 24 months, longer if you're from India or China.

USCIS routes EB-1A petitions to either the Texas or Nebraska Service Center based on your state of residence. You don't pick. Current processing times are published at USCIS Case Processing Times and updated monthly. Premium processing, available since 2022 for EB-1A, is the single biggest lever on the I-140 timeline. Stage 2: After I-140 approval
I-140 approval means USCIS has classified you as a person of extraordinary ability. It does NOT mean you have a green card yet. To get the physical card, you do one of two things:
If you are inside the US
File Form I-485 (Adjustment of Status) with $1,440 per adult. USCIS currently adjudicates I-485 in 8-14 months. You can file I-485 concurrently with I-140 if your priority date is current, which can shave several months off total time.
If you are outside the US
Consular process through the National Visa Center and your nearest US embassy. The NVC stage takes 3-6 months for fee payment and document collection, then 1-3 months for the embassy interview, then the immigrant visa gets stamped and you fly to the US. Total: 6-12 months from I-140 approval to entry.
The priority-date impact
A “priority date” is your place in line. Most EB-1A petitioners from most countries have a current priority date, which means no waiting. But for India and China, EB-1 numbers have been periodically backlogged for years. Check the Department of State Visa Bulletin before filing. Two columns matter:
- Final Action Dates — the cutoff that determines whether you can finalize the green card (I-485 approval or visa issuance).
- Dates for Filing — an earlier cutoff that determines whether you can submit the I-485. USCIS announces each month which chart applies.
For India EB-1, the priority date as of mid-2026 is roughly 2-3 years backlogged. For China EB-1, 1-2 years. All other countries: current. If you're a self-petitioner from India or China, talk to an attorney about whether O-1 plus eventual EB-1A is faster than EB-1A standalone.

What slows EB-1A down (and how to avoid it)
- Request for Evidence (RFE). Roughly 1 in 3 EB-1A petitions get one. RFE response deadlines are 87 days. Adding 4-9 months to total time. The best way to avoid an RFE is to over-anchor every claim in regulatory language, archive every web URL, and certify every translation before filing.
- NBC review hold. Premium-processing premium can be paused if USCIS opens a deeper review. Rare for EB-1A but documented.
- Service-center transfer. USCIS occasionally moves a case between Texas and Nebraska. Resets the clock by 30-60 days.
- FBI name check. Required for I-485 stage. Usually fast for people with no criminal or immigration history; can take months for common names or international travel patterns.
Tracking your case
USCIS mails you Form I-797C Notice of Action (a receipt) 1-3 weeks after filing. It has your 13-character receipt number. Use it at Case Status Online for live status. You can also sign up for email + text alerts using Form G-1145.
Get to filing faster
USCIS processing time is mostly outside your control. Preparation time is fully inside it.
